Sotomayor's First Day.
@2, I agree with you that most of the criticisms of Thomas are weak, but I do find that his approach to lack any intellectual curiosity, I know that in theory all he need do is apply the constitution, stare decisis, and the briefs to the case at hand, and that oral arguments have very little bearing on the outcome of any case.
But, it just seems that his approach is so formulaic as to destroy any admiration or respect for him. I guess I just have higher expectations from the justices. In addition, from what I've read, he is a sad man, I mean he is against affirmative action, when it is very clear from his history that he greatly benefited from it. The only reason he was nominated for the position was that they needed a black justice to replace Marshall and he was the only black judge who the Republicans could stomach.
I guess in some weird way he himself is a great argument against affirmative action.

I think what is even worse is how poorly the area around Safeco and Qwest has been developed, you would think that with as many people that attend games and events in the area there would be significantly more dinning and drinking options...if strip clubs are all that want to be down there, well, I guess that's tough titties for Safeco.

@6, Thomas has been pretty consistent with his belief that oral arguments are a waste of time, and I kind of agree with him, I mean, personally I would find it disconcerting if major constitutional issues were primarily decided by the persuasiveness of consuls oral abilities (that sounds really dirty, but it isn't), rather than interpretation of relevant case law and the Constitution. It makes for great theater, but shouldn't really hold much weight when the justices make their decision, IMO.

Dan, I would just like to say, that I can some times get mad as hell at some of your posts and articles, not because I disagree with the underlying goals, but how you go about achieving those goals, but, it's posts like this that really make me a big fan, the the courage to be both open and considerate of your partner is very admirable.

Finally, I'm all for protesting the President, but up until now Congress (the ones who can make real lasting change) have been left of the list of those to protest, let your elected officials know that they cannot let Obama be the fall guy, if this all goes to hell they will share equally in the blame, and share equally in the success.

@110, protest all you the fuck you want, and don't shut up, but do it with some intellectual honesty, Obama favors a legislative solution, and rightfully so as that will be the only way for it to be durable and lasting. Everyone seems to want to avoid the hard work of petitioning congress and would rather have Obama act on his own, which is the same type of executive branch power grab that Bush used numerous times to horrible effect.

@21, as for that anal lawyeristic quabbling, you are right, that overall it is bullshit, but that is how the law works, all your righteous anger is not going to change that, if your advocating for a whole new legal system, cool, but if your talking about this brief in our current legal system, then these are the rules we play by, so you either deal with it, and deal with it with some intellectual honesty, or just shut the fuck up.
Again, I'm for equal rights, and I agree with Kevin, why isn't this anger directed at Congress, they are the ones that have the power to repel DOMA, and they haven't done anything, even with a majority of both houses.
But hey, let your anger and frustration blind you to the point where you call those that support your cause but differ on the how to achieve it a douchebag.

Dan you are being disingenuous. The brief is based on existing case law, which is the basis for most if not all arguments in briefs. If you are arguing an issue that deals with the full faith and credit clause and marriage, and that is the only case law that exists, then that's what you use. If you look at the arguments in the abstract, and remove the actual acts, then it makes sense, and that is what you do in a brief.
Your lack of understanding of the legal process is frustrating, as you pick and choose what to hear, and then push it out there as the sacred truth that is incontrovertible.
I'm for equal rights for gays, but I'm not for a witch hunt that engages in the same type of hyperbole and mischaracterization that we all suffered through during the Bush years.
