As a franchisee attorney, I have watched the IFA botch this entire case from the beginning. They have been so damned focused on representing the franchisors that they have done a crap job of representing the franchisees who will be hurt by the roll out. Franchisees pay 7-10% of their net sales to the franchisor and can't do much to adjust their business model because franchise agreement and the operations model give the franchisor exclusive control over many aspects of the business. They don't have the ability to "get rid of the dead wood" without violating their franchise agreement and risking losing their store. It's terribly business model for the franchisees As to hiring Paul Friggin Clement to handle the case that was just a bonehead move. The IFA doesn't understand that people don't like corporations and aren't real concerned about their "rights."

@22-The really big franchisors require franchisees to have significant personal wealth (that usually includes houses, retirement savings ect) but roughly a third of all small businesses in this country are franchise and the vast majority of franchisors require much less and allow the net worth to the aggregate of a group of franchisee investors (Mama, papa and the kids for example.
@6-I spend 40 hours a week dealing with franchisors and they are unlikely to "restructure" anything to benefit a franchisee. If a subway franchisee goes under the franchisor gets to take over the lease and sell the location to another franchisee who pays another big franchise investment fee. There's an incentive to flip franchisees.
@ 5 and 16-I hope the final results counts employees based the number of employees of the franchisee (say Joe's sandwiches LLC) rather than the franchisor (subway). It would catch the true "big time" franchisees and let the small fry go. That is the typical way courts treat the question now but there are many many law review articles on the topic.
I worry about franchises because I work with franchisees. These people have invested everything and are frequently working without pay because they got screwed by the same big corporations that are screwing the rest of the 99%. I resent the corporations and private equity firms taking the lion's share and letting the rest of us fight over the crumbs.

If the 500 plus employees counts franchises that means a HUGE amount of what looks like small businesses (Quizno's, McDonald's, Subway ect) are all going to have to meet the shorter phase in period. A franchised business basically gets the "business model" in exchange for a big upfront investment and significant royalty fees. Usually the owners are rookie business people and are barely getting by. And the franchise agreements typically don't let a franchisee make the kind of adjustments in pricing or staffing to cushion the increased labor. This plan will make it impossible for most franchisees in Seattle to operate their businesses.

I would really like to the Slog and the Stranger take a good look at how a $15 minimum wage would affect franchise businesses (which are a huge chunk minimum wage paying businesses). Most franchisees are locked into staffing and pricing and are either losing money or making tiny profits (the franchisors are of course doing fine). Unlike an independent business owner the franchisees can't just close shop without losing their entire investment and having to pay "lost royalties" to the franchisor which can easily amount to hundreds of thousands of dollars. Franchisees are usually required to personally guarantee their business obligations so it would lead to personal bankruptcy too.

Goldy, I like you and I HATE her but this whole post and lord knows your commentary is the kind of misogynist bullshit I would expect from the other side. Yea she's putting on makeup while watching the speech because society (especially team red) still demands that a woman, ANY woman, who dares to appear in public meet the narrow beauty standard before she is worthy of a job, respect, or a chance to heard. So she either plays along or is out of job. But of course if she tries to meet the standard YOU give her shit because lipstick and hair= incapable of intelligence. This bullshit should be beneath you. If you need coaching on how to talk about women without talking about their looks (including mocking them for enhancing them) I hear the republican party is giving classes. Maybe you should enroll.

Mora's is pretty good in the summer but the scoops (which are crazy expensive) double in size once the season is over and the tourists have gone home. Their pumpkin is one of the reasons October on Bainbridge rocks.

So I have a family member (he's the black sheep) who worked very closely with JHB. Closely enough that several years ago I sat next to her at a baby shower. She was lovely and mentioned how much she adored children and wanted a family of her own someday. I dislike her politics but my heart's breaking for her.

I kinda miss sweet doofuses like this from my days as prosecutor. These kids would show up, have no frickin' idea what they were protesting, cause trouble, insult or attack the arresting officers and then get cute with me (stupid but expected) and the judge when they showed up in court (never a good idea). Frequently they ended up spending a few days in custody not for protesting but for the stupid shit they did afterwards (throwing books at the judge, calling everyone pigs and dropping trou). On the other hand, the grown up protesters had a coherent reason for why they were protesting and if they were arrested is was a planned act of civil disobedience. They were usually very polite to the police officer, judges and attorneys. One frequent protester/arrestee explained to he understood that everyone was just trying to do their jobs. Shockingly the grownups rarely spent anytime in jail and were treated respectfully by the officers, court staff and attorneys.
