I'd be careful about hitting Germany with burdensome reparations--They haven't responded favorably to those in the past.

This is Phase 4 of the VW pain in America. They've worked out Phase 1, buying off the Feds. They are also having to buy off their dealers (Phase 2) and the individual owners (Phase 3). The states have their own regulations, which is going to make Phase 4 really painful when California comes after them.
Then they get to deal with Phase 5, the holdouts. The environmental lawyers from Santa Monica who bought these cars specifically to bolster their green credentials and in turn had their reputations tainted. They are going to want their grandstanding day in court, and VW has already admitted guilt.
Too bad Congress is so dysfunctional right now, or VW could have spent about $1billion on immunity legislation instead. Odd the Germans didn't think of the NRA solution.

So happy to see VW revealed as the sleezeballs they are, for all the world to see. I was burned badly by them when they refused to fix a major engine issue with my Jetta - while the car was still under warrantee. The car was 18 months old and had less than 36k miles on it. I baby my cars, never miss an oil change or any maintenance, and the fucking thing ran completetely out of oil in between the 5k oil changes. When looking into this online, I saw that this was a major issue for that model - something about some rings being installed upside down, and the fix was to pull the engine, do it correctly, and put it back in again. A $3k repair. Thousands of people were running into the same issue with their Jettas, and all of us ran into the same bullshit and lies from them. I was ping ponged between the dealer and VW, back and forth as they each pointed to the other for months - even though they acknowledged the car was burning oil - all during the period my mother was dying of cancer, no less. Finally the service manager's suggestion: "Well, just carry oil with you at all times and top it up when necessary."

The saddest thing is, my dad had VWs from the 1950's on - I grew up a VW gal, and drove many of the old bugs and fastbacks, squarebacks and buses; hell, even the Thing, and would have been a lifelong loyal VW customer. My whole family would have been. Did they give a shit about that? Of course not.

The car had very likely already undergone engine damage due to being chronically low on oil and they knew it. Did the guy notice when they changed my oil all those times - this was the dealer, too - that the reserve was always almost empty? Did they say a word to me about it? Nope.

VW taught me the hard way that a warantee is only as good as a company's willingness to actually honor it.
