Slog tipper Hawke brings news that the crazy birther lady's lawsuit against Obama was all but laughed out of court.

Plaintiff’s complaint is not plausible on its face. To the extent that it alleges any “facts,” the Complaint does not connect those facts to any actual violation of Plaintiff’s individual constitutional rights. Unlike in Alice in Wonderland, simply saying something is so does not make it so.

That's a good literary reference, there, judge. Taitz will of course not give up. She claims the judge has disrespected the Constitution and he should be tried for treason with Obama. Paraphrased, this means that she will not let reason stand in her way.

After reading the Birther's blogs, it is clear to me that President Obama's life is in danger. These folks are unhinged to begin with, but now they have exhausted all legal remedies. They will irrationally conclude that they have no option but to stop "The Usurper" by force.

I fear for the safety of President Obama. The efficacy of the Secret Service will be severely tested during the next few years.

The Teabaggers, Glen Beck, Birthers, etc. will all have blood on their hands. Their irresponsibie rhetoric is driving this irrational frenzy to the logical conclusion.

The good people at Talking Points Memo called Ms. Taitz for a comment on the ruling, and she had this to say: "In an interview with TPM just now, Birther evangelist Orly Taitz fired back at Clay Land, the U.S. district court judge who tore apart Birtherism and threatened Taitz with sanctions in an order today, saying that "somebody should consider trying [the judge] for treason and aiding and abetting this massive fraud known as Barack Hussein Obama."

"This is so outrageous what this judge did -- it goes in the face of law and order," said Taitz, reached at her office in Mission Viego, CA. "Not every judge is as corrupt as Judge Land. Some judges believe in the Constitution. And some judges believe in the rule of law."

When asked if her client is open to continuing the fight, would Taitz go along, she says: "Oh absolutely, absolutely," she said. "Listen, Nelson Mandela stayed in prison for years in order to get to the truth and justice."

You just can't make this shit up~

@4 - thanks for the link to the judgment. I had no idea that judges could be so sarcastic. My favorite passage:

...Plaintiff’s counsel, who champions herself as a defender of liberty and freedom, seeks to use the power of the judiciary to compel a citizen, albeit the President of the United States, to “prove his innocence” to “charges” that are based upon conjecture and speculation. Any middle school civics student would readily recognize the irony of abandoning fundamental principles upon which our Country was founded in order to purportedly “protect and preserve” those very principles.

As a practicing Attorney at law, I can assure you folks there is much more involved in qualifying as as "natural born Citizen" than simply being born on U.S. soil. In 2008, the Senate Judiciary Committee investigating whether or not John McCain is a "natural born Citizen", decided what the most important qualifying factor is. I'll let you see for yourselves who was on the committee and what their ruling was based on. Remember, by law, what is required of one candidate, MUST be required of ALL candidates. Oh, and @30 - our citizenship laws have never required either parent to be a U.S. citizen. You simply have to be born on U.S. soil. To run for President, you have to be a U.S. citizen. Andrew Jackson had two immigrant parents, and five other presidents had one immigrant parent. And I can assure you, none of the Founding Fathers' parents were U.S. citizens.

Currently, Title 8 of the U.S. Code, Section 1401 defines the following as people who are "citizens of the United States at birth:"

* Anyone born inside the United States
* Any Indian or Eskimo born in the United States, provided being a citizen of the U.S. does not impair the person's status as a citizen of the tribe
* Any one born outside the United States, both of whose parents are citizens of the U.S., as long as one parent has lived in the U.S.
* Any one born outside the United States, if one parent is a citizen and lived in the U.S. for at least one year and the other parent is a U.S. national
* Any one born in a U.S. possession, if one parent is a citizen and lived in the U.S. for at least one year
* Any one found in the U.S. under the age of five, whose parentage cannot be determined, as long as proof of non-citizenship is not provided by age 21
* Any one born outside the United States, if one parent is an alien and as long as the other parent is a citizen of the U.S. who lived in the U.S. for at least five years (with military and diplomatic service included in this time)
* A final, historical condition: a person born before 5/24/1934 of an alien father and a U.S. citizen mother who has lived in the U.S.

Citizenship of the parents is irrelevant.

Oh, for heaven sakes, ONLYTHEFACTS, it is a tired old ploy to misread that Senate Resolution about John McCain. If you actually read it properly, though it is about John McCain, not Obama, it fully supports the notion that to be natural born you either are born on US soil or have a parent who is a US citizen. As you may recall, the issue about McCain was that he was born in the Canal Zone, though some alleged that he was born in Panama and not in the Canal Zone. The committee first found noted that the Canal Zone was a US possession and therefore he is "natural born." The report goes on to say - and here is where you try to misread it - that in any event, both of McCain's parents were US citizens, so even if the Canal Zone as a possession and not a state didn't count as US soil (or if the rumors that he was actually born in Panama were correct), he would still be a US citizen.

If your misreading is correct, where are Sen Leahy and the other members of the Senate Judiciary committee? You think they'd be all over this. Pat Leahy was a "practicing attorney" and a good one, in the state I live and practice as an attorney. Certainly he could "assure" all the people who are not "practicing attorneys" and therefore without your specialized knowledge, that you, ONLYTHEFACTS, are absolutely correct. That is, if he agreed with you.

Are you really a practicing attorney? I tend to doubt it. An attorney would know 1) a Senate Resolution has little or no legal effect, 2) that when you blatantly misread something to say what you want it to say, that doesn't make your argument stronger. It makes it weaker.

By the way, I am a practicing attorney and one of the first things I learned in law school is "wishing doesn't make it so." I'm sure you wish that that Senate Resolution about McCain means that to be a natural born citizen one must be born in the US and have both parents be citizens, but wishing doesn't make it so.

Shame on you.

Oh, I don't know, @36, judging from some of the work product I've seen in my life, there's no shortage of attorneys in the world who can't string six sentences together coherently. Sad, but true.

As I said earlier, I feel sorry for the judges who have to read his briefing, though.
