UPDATE: The City Attorney's Office responds to the verdict: “Officer Haynes kicked a man in the head while the man was handcuffed and face down on the sidewalk," City Attorney Pete Holmes said in a statement. "I am disappointed that the jury chose not to convict in these circumstances, but I respect the jury process. Today’s verdict will not deter us from doing what we can to hold all people, including police officers, accountable under the law."

The release continues: "Since Holmes took office in January 2010, the City Attorney’s Office has been referred three cases of possible assault by police officers. The office declined to file in one, and filed but later dismissed another because an expert witness changed his opinion. Officer Haynes’ case, the one taken to trial, was the only one of these three cases where the victim was handcuffed at the time the officer used force against him."
