I am likely far too naive, and I have not followed this latest bit of idiocy too closely. But it seems to me that there are two ways of securing a victory in the court. Either you craft really persuasive arguments in support of your proposition, convincing the court to rule in your favor despite its not having done so before. Or you cobble together the worst, weakest possible arguments against it, leading the court to believe that there is no cogent argument against a particular proposition. Could it be that the administration chose the latter course, stringing together for the court's convenience all of the most hackneyed, most rejected and weakest arguments in support of DOMA?

I don't know that this is what was done here. But I think it's something worth considering.

Before Roe v. Wade, states were grappling with the abortion issue (some more progressively than others). While I agree with the decision, many scholars all over the ideological spectrum agree that suddenly making a national rule (a) angered a lot of people still wrestling with the issue and (b) created a polarizing wedge still going strong 30+ years later.

While I can see why DOMA would anger a lot of people, gay marriage as an issue is winning in the states; people on both sides are starting to see it as a fait accompli. And DOMA doesn't ban gay marriages; it says (except for the odious bit about the feds not recognizing them) that states need to work it out for themselves. For a guy aware of the historical effects of Roe v. Wade (and trying to build a coalition to tackle health care -- the Sisyphus of national policy), this seems like a reasonable tack. Again, for people who donated to him in part on this issue this is a betrayal. But as someone with no horse in the DOMA race (apart from a general sense of common brotherhood) it seems to me like right now, it might be a Pyrrhic victory.

Hypothetically speaking, which benefits the greatest number of gay people: repeal of DADT, or health care reform?

I'm not saying that both aren't important. I'm just saying that any organization has to order objectives and deploy resources according to that order.

The time to apply this kind of pressure comes in one year and in three years. That's when the appeals come in for more Democratic senators and for a second term.

Americablog is wrong wrong wrong. As a lawyer, I can tell you that the adminstration has to defend DOMA unless it is clearly unconstitutional. Does this come down to your feelings are hurt about the wording of the brief? To be honest, the more offensive the brief is, the more likely the court is to determine their is no rational basis for the federal government's discrimination.

What would a successful ruling in their favor have meant? What are the reasons one might favor a judicial strategy? On the other hand, what are the reasons one might favor a legislative strategy? What is generally the role of the DOJ in such cases? What was Obama's actual campaign promise? (Did he pledge to work to overturn DOMA judicially or legislatively?)

My mother is a Constitutional Law Professor, and she says that numerous administrations have declined to actively defend (note: merely not defending a law does *not* mean it will necessarily be struck down) laws that they found especially objectionable and that doing so is well within the Executive Branch's prerogative, although a systematic policy of declining to defend *any* law with which the administration merely disagreed would be problematic.

The passage of the hate crimes bill is important on a fundamental, constitutional level. Think about why consensual sodomy was fine to criminalize under Bowers v. Hardwick in the 1980s but suddenly not in Lawrence v. Texas in the 1990s.

Don't get me wrong, I am furious that Obama has abandoned his campaign promises and seems to gauge this country too angry and too hateful to tolerate equality.

But that kind of cowering apathy is why the Supreme Court had to go ahead and decide Brown v. Board of Education.

If you voted for a Democrat for president because the only thing that gets you more excited than low taxes is getting married - and you're going to stop voting Democrat the day you can - then I don't shed a tear for you when you don't get your way immediately.

Americans have been waiting a long time for a 1st world health care system. You know, the right to not die because you don't have the money to pay for cancer treatment. #71 - I agree. Dan should've STFU and go away like some folks are saying. This is an unfair situation and the more noise made about gay marriage, the better! But I think unless we fight effectively then nothing is going to change. And we need to start by taking the fight to those who have the power to write, change and repeal laws. Complaining to anyone else is basically pissing into the wind.
