Dude, the cop was responding to a complaint. That's what they do—whether it's a barking dog or loud car stereo or some smokers that upset some busybody. Of course they can use discretion, but this wasn't exactly the one man war-on-drugs you painted the guy with.

The "half a pipe" comment is pretty solid, and should be entered as proof of competence to stand being kinda awesome, except for the assault part.

That's what the drunk-tank is for at the local cop shop. Leave the guy in it until he's somewhat coherent and then send him on his way with a stern warning.

Having not actually hit the cop with the piece of smoking pipe, which probably wouldn't have even hurt him had it hit (the broken edge most likely happened when it hit the ground), the most they could charge is probably attempted aggravated assault, which given the guy's condition was a pretty weak attempt.

I saw the cops ticket 3 kids smoking pot in the park at 50th and 8th. I am not sure why people who wouldn't openly drink a twelve pack in the grass think joints are ok. I generally don't give a fuck either way, but the parents with kids probably do.

Thank you for not taking pupuguru's suggestion, as "pass time" would have offended my eyes even more than "past time."

@4 - The assailant still had half a pipe on him, implying, as he said, that he threw half a pipe. Sounds like it was already broken when he threw it, unless it was some kind of two-piece pipe, like a clarinet, but for pot.

@4 - I don't know if they'll bother to prosecute this, but you can be charged with assault for simply swinging and missing. Injury isn't paramount the charge.

A Colorado appeals court ruled that employers can fire for off duty mj use. Washington courts may go the same way, but certainly will support on-duty mj use like these fools. What kind of service do I want to use where the employees are stoned? Dumb asses.

@11 that's battery. It has both positive and negative connotations when you actually hit someone.

"Battery" is not mentioned in the RCW, but there are varying degrees of assault.

@16: WA's weird in that it misuses the word "assault" to mean "battery" in a number of cases. Assault is the credible threatening of harm, battery is committing the harm, yet the RCWs call both different degrees of assault.

Must be fun when lawyers from other states specializing in criminal law come here...

@12- No state is going to get in the way of firing people for being stoned, drunk, tripping, etc... Washington is a "at will" state, employers can fire you on a whim.

That said, I don't care if someone's blazed to high heavens as long as they can do their jobs. Some people are going to be much better dishwashers when their baked. Lord knows it's my favorite way to do the dishes.

Growing up, my pops would occasionally bring over his old IAM buddy Dan, who would regale us with stories of his ill-spent youth. My particular favorite was one Summer in the early 80s getting pulled over driving seventy-five through residential Auburn. The cop storms over to the car: "Son, do you have any idea how goddamn fast you were going?" Dan, never one to really think these things through: "No dad, how fast WAS I going?" The officer simply reached in, pulled him out the window by his collar, and busted him across the jaw. The ticket was settled out of court.
