Did her quotation even imply that she believed such or did she simply...quote him?

Anyway, the congress should be the first to admit the constitution isn't perfect...wait no, that would be the "founding fathers" since they gave congress the ability to change the constitution.

Kagan would really be in trouble if she quoted what Jesus said in Matthew 19:4.

I titter with joy whenever I re-read the Constitution, but we seriously need to stop deifying the founding fathers. Three-fifths was a compromise?

@1: Agreed, but the reasoning for using this tactic to go after her is sound. If you want to pump up your base to hate her, say she's a nondogmatist who doesn't believe historical documents were created inerrant. That really pisses the evangelical right off like nothing else.

Defective? Hmm, the Confederate (i.e., currently Republican) States somehow found the Constitution defective, since they seceded from the Union. 600,000 Americans died in the bloodiest war in our history less than 70 years after the ratification of the Constitution, but it wasn't defective? Holy crap, Republicans are stupid.

Well, defective enough that the congress has amended it 27 times. But who's counting?

congress does not amend the constitution - they may, and have, proposed amendments to the constitution - but the constitution is amended when 3/4 of the several states amend it, by various ratification proceedings at the level of the state legislature and usually requiring supermajorities
