I doubt the unborn or the dead for that matter are free (Martin Luther King's tombstone reads "Free at Last, Free at Last. Thank God Almighty, I'm free at last" so, he clearly refutes that the dead aren't free). However, I remain dubious that I'm not "free to choose" while very much alive. I side with Jean-Paul Sartre who remarked "You are free, choose".
