Someone needs to test whether she is a judicial activist or a strict constitutionalist. So...

Given that the people's right to keep and bear arms shall not be infringed, why can I not have unregulated weapons of mass destruction?

Also, given that the 2nd Amendment was ratified by the various states with different text, has it actually been ratified?

Not that she'll answer either one. Conservative nominees like Kagan never do until they are appointed to the Supreme Court. Which, in case nobody ever told you, is not a lifetime appointment, but has been treated as such only in the current century.

@9: No, the Constitution doesn't specifically say "lifetime," it says "during good behavior." Which has always in practice meant an indefinite term of appointment. In the history of the court so far, one justice was impeached, but acquitted and thus not removed. So, I think it's fair to say that it's always been a lifetime appointment, and that you are either pointlessly splitting hairs, or stupid.

Or both.

There's no reason for SCOTUS judges to bring the concerns of average American families to the bench. They're not there to bring ANYBODY's concerns to the bench. They're there to be jurists, not advocates.

First of all, Matlock, the term is "strict constructionist." And second, what you're arging for here is not strict constructionism, but something like a seriously warped form of textualism, wherein laws written two centuries ago are interpreted based solely on the modern meanings of the words they happen to contain.

Generally speaking, if you think you have discovered a "gotcha" argument that cinches some enormous, long-running legal debate, it's probably just because you are entirely ignorant of the law, its history, and how it is applied.

I would ask Kagan why she does not support a thorough study of genetically modified foods and their impact on the environment and human health.
