They can probably expect legal protection against retaliatory firings.

However, the new chief should shove the regulations right in their face, and if they don't like it they can quit. They are city employees, and the city will decide how this town is policed, not the unions. The right mayor would bring this point home. Sadly, I don't think we have one.

The union for high-ranking officers is suing to prevent the new chief from hiring out an outside assistant chief. So basically the police unions have declared war against the city management.

Washington State and the City of Seattle need to CHANGE THE LAW so that the city can REQUIRE police officers to live within the city where they are employed to serve.

Hiring police officers to serve Seattle who then choose to live miles and miles away in other cities and counties creates a negative disconnect between them and the community they are meant to serve. This disconnect needs to end.

We pay these officers a salary reflective not only of their job, but also of the cost of living in Seattle. If we're not going to require them to live in the community where they serve, we should at least reduce their salaries to reflect their real cost of living outside the city. If they don't want to live here, we shouldn't pay them as if they do.

To the officers that joined this lawsuit, you are part of the problem. While we don't know if you are all simply cowards or sociopathic killers who don't like being told "no, stop or don't," we do know you've taken the wrong position against your community. If you can't or won't serve the city of Seattle according to the standard set by the city and its people, you deserve to be relieved of duty.

The people of Seattle are tired of paying for a police force that serves their own self-serving agenda - the communities of Seattle be damned for all you care. And, we're tired of the good officers who live in this community and serve it well having their reputation soiled by the cowards and liars that dare to wear the badge and stand beside them.

If it takes the DOJ to give this city the leadership and courage that it is so obviously lacking to do the right thing, so be it.

It's time to break that union. Force them out on strike and then fire the whole shebang and train up a new department from scratch, with senior officers hired from other departments. If you can identify keepers from the old department, then keep them. Fill in any temporary gaps with a private security firm. Just don't let Blackwater drive around with jeep-mounted miniguns and you should be okay.

Sweet Jeebus anyone read the actual lawsuit? It's comical. Like some guy who has watched too many episodes of The Practice wrote it in his spare time. A 1L law student wouldn't write something this bad. This has to be a joke. Stay classy SPD. I want to support my local beat cops but sometimes they make it so difficult.

So yeah, written by some of the cops involved, and they're looking to bankroll an in State attorney with the complaint.

They not only claim they're representing themselves, they are LEGALLY representing themselves. They've filed this case pro se, meaning as individuals with no legal representation because, they claim, it would be too expensive to hire an attorney. I doubt if they could find an attorney.

Remember that anyone can file a suit. That doesn't mean it will survive in court; there are any number of reasons it could be dismissed.

Murray, in a terse statement issued Wednesday afternoon, said he has yet to review the lawsuit and it would be inappropriate to immediately comment.

“But I will say: the Seattle Police Department is under a federally-mandated court order, in part because of a disturbing pattern of unnecessary use of force and other forms of unconstitutional policing,” Murray said.

“The police department will comply with that court order. The City of Seattle will not fight the Civil Rights Division of the U.S. Department of Justice. This is not the 1960s.”

1. SPOG didn't file the suit and isn't a part to it, and for good reason. If you read it, you'll recognize it's a joke and is going to get tossed out in about 5 minutes. I don't see how it's fair to blame a union fior something they're not involved in.

2. For those of you that want a residency requirement for SPD officers, be careful what you wish for. Right now whatever political pull they have is diffused by the fact that many of them don't live in Seattle. If all the sudden you add a thousand people, plus their spouses or significant others, to the city's voter rolls, you're actually *increasing* the political power of the union.

You're political theory could not be more problematic; it is devoid of a basic understanding of human sociology and psychology.

By allowing officers to segregate themselves from the community they serve, you invite into the police force those who despise the people of Seattle and would never live here, but who are more than glad to collect the bigger paycheck with the cost of living adjustment and simply live as far away from the city that they hate as they can.

Requiring officers to live among the community they serve will weed out the worst of the city's haters and force officers who have previously avoided forming social connections here to see themselves as one of the people in Seattle instead of separate and different from them.

It will also help the community to see our better officers as true members of the community rather than an employee.

If the officers in the union have to live here as one among the community they serve, their perspective would become informed by that experience the same as any other member of the community.

...and that is worth wishing for.

Reminiscent of the AMA's reaction to Nixon's attempts to expand Medicaid. They dug in their heels and declared that they were in it for the money (despite a large % of membership getting their degrees from GI Bills & state schools).
40 years later, and docs are swimming in debt & paperwork because everyone else noticed they were making piles of money.

These SPD officers have declared that they are in it for the bloodlust. They shouldn't be surprised at the eventual consequences - Americans are armed to the teeth.

Any one of you will whine and whimper if a cop takes 5 minutes to get to you when your purse is stolen (and most of you aren't even women). But when a policeman says hello in passing you on the street it's harassment.

A job policing you deviant overgrown toddlers? There isn't enough money in the world.

@30 - historically, residency requirements were used largely to create political machines. There were always other superficial reasons given for the residency requirement, but the end result was to create political power. Whatever you think would happen, that would be the end result here.

And let's talk about your argument about building connections with the community. Do you really think that when an officer is told "I'm going to fucking kill you and your family" that they are somehow going to want to build a connection with that person by living in the city? That's asinine.

@35, That's always been the excuse for commuter cops, but the reality is that the cops make enough money to not live in high crime areas and the city is big enough that they're unlikely to even live in the same neighborhood as their beat. Small town cops live in town and it's rarely an issue there even though you wouldn't have the anonymity that you would in a larger city.
The problem with having cops that commute in is that they don't give a shit what happens in the city. They're the occupiers policing the indigenous population. I live here. I give a shit. I don't care nearly as much about Kent or Renton. That's basic human nature.
Another problem with the commuter cop or fireman is what happens in a natural disaster. When SF had their earthquake most of their firemen and cops weren't even able to get to SF from where they lived in Oakland. When they needed them the most, most were unavailable.

The Seattle Police Department has just over 1,300 sworn officers and approximately 533 civilian personnel.

King Country has over 1.1million registered voters with a participation rate in the 2012 general election of approximately 84%. The overwhelming majority of those voters are in Seattle.

Seattle is by no real measure a reflection of the realities to which you refer and imagine it to be from 19th and early 20th century America.

A police force that represents less than ONE PERCENT of the registered voters that participated in the last major, general election is NOT a "political machine" by any stretch of the imagination.

And the union would be no more powerful with officers required to live in the city than it is now with most living outside of it.

Conjure whatever version of reality you want from any available orifice, but the data out here in the real world simply doesn't support your position.

Feel free to return to whatever games or movies that inform your point of view.

Oh, one question: You don't actually live in Seattle, do you?

As for voter registration: I'm curious about things like whether the plaintiffs tend to live in a particular area (or not in a particular area, such as Seattle).

@60 I don't get it. Do you feel that an officer who lives in Kent or some outlying area is more prone to violence? Or has less of an interest in the societal expectations of the people in Seattle? Are we looking to see if they all live on some extremist militia compound with their 7 wives each?

As for a web search of an officers name and/or badge, how would the information be relevant? A public records search will identify the plaintiffs in any civil suit.

I still don't see the need for this list, or understand a use for it beyond the possible harassment of officers and their families at home. Is that the point? To harass them and their families at home and make them sorry they filed this suit?

@61 Well, for one thing, Phil has done a service for the new chief, preparing a nice, alphabetized list of some officers who might need extra oversight. Also, if any of their disciplinary records or incidents are public, some diligent reporter could cross-reference them and maybe write an article about SPD's malevolent underbelly.

If you don't read the whole thing, read starting at #7 on page 6. Officers state they are CHOOSING to no longer respond to calls and CHOOSING to ignore requests for back up by their fellow officers. They avoid acting in a 'reasonable response' or otherwise 'do nothing' when there is a threat to public safety.

The list of plaintiffs is available on a dozen news sites - none of whom recommend using the information to look up the involved officers home address. Why the interest past the plaintiffs list in the officers home address? Why not just come out and say you're looking to make the case that commuter cops are -(theory here)-, if that's what you have in mind?

What exactly could you show if all 123 officers live outside the city? A propensity of suburbanites to use the legal framework we have available as americans when we feel our rights are threatened?

This lawsuit is awesome, it lets these officers bring the fact that they feel they can not do their jobs without bullying and violence as first tactic into a legal and on-the-record forum. I really want them to keep filing more of this stuff FFS, don't scare them off!!

I forgot to mention Officer Leslie's use of force

"This was the case for James Anderson. He was outside a West Seattle restaurant in 1988 with friends who had been involved in a fight, when he was struck in the face by Officer Rusty Leslie. The blow broke his jaw. His mouth had to be wired shut, and he was out of work for a month. He had been charged with no crime"

Leslie was found to have used excessive force, but the finding was overturned on appeal.

Testimony in ths incedent included that of Police Chief Fitzsimons, who described a similar incident in which Officer Leslie "happened to hit someone in the face with a gun [because] it was the only thing he had in his hand"

Not saying that all the signators on the filing are problem cops. but they sure will be fun to google

Thank you plash for posting that. I forgot about ALL of those stories. Just my (and my coworkers') personal interactions with him day-to-day. This was a good 10 years ago, a past far behind me. But there are very sordid details about that officer that clearly go back for decades.

To be honest, I can't believe he still has his badge. I have several friends that are cops. Yeah they like to drink while off duty, but do it in a mature, responsible fashion - and are GOOD respectful guys who live in the city and appreciate what differences they make. I have to say in Leslie's instance, it is the badge that has bloated his ego.
