The Federal case is about the Constitutionality of Obamacare, not it's merits. McKenna, like him or not, is doing exactly what a state AG should; he is arguing the legal position without regard to his personal beliefs. I would think you would be commending him for at once supporting the policy in his heart, while still being able to function in his office and protect the sovereignty of individual states.

Another (untold) McKenna story is the terminal damage he in his Ayn Rand/Tyrannocapitalist hostility to consumers' rights has done to consumer protection in Washington state. Where once we had the toughest most rigorously enforced consumer protection laws in the nation, now thanks to McKenna the consumer is always wrong. Complainants are routinely treated like criminals by the AG's consumer "protection" branch, which -- now that "businessman" has become a synonym for "thief" and "capitalism" a synonym for "thievery" -- McKenna has turned into a capitalist-protection agency instead.

I agree that some of McKenna's comments on the effects of the suit have been, at best, finely parsed phrasings that are technically true on a limited reading. But other comments and press releases have added clarifying context and information to give the whole picture. So how to judge his statements: in isolation or in the context of his other statements? If you read all of his press releases and the FAQ on his website, you understand what is going on.

Also, even if McKenna is acting against an interest of the citizens, that might be okay if the action is in furtherance of another possibly conflicting interest. Clients have competing interests, and the lawyer's job is always to balance those. If the financial/time benefits of joining a plaintiff group outweighed the detrimental effect of being subject to the group's majority views, that would be a fine decision for a client to make.

Yet, through all this, Jay Inslee is still largely unknown, so this creep will become Governor by default. I have never seen a more lack-luster campaign than the one being run by Inslee. So sad, as I think he'd be worlds better than McKenna. Sigh.

Wonder if the stranger has done any research on inslee's "lawyering". oh, that's right; he hasn't done any since he has been a professional pol (like McKenna) his whole adult life and has what to show for it? Not much. Other than being 1 of 435 people who consistently spend more than we take in as a nation and talk more than anything, jay has not done much of anything.
