The City Says the Last Black-Owned Nightspot in the Central District Is a Public-Safety Threat. Is Racism a Factor?

"The city has never cited Waid's for a noise violation"

This is true, but I think you need to take into account exactly how difficult it is to get a noise violation. Seattle has three people who can take a sound reading, and they are in charge of the entire city. A usable sound reading takes about a half-hour to conduct, not including transit time. The fact of the matter is that the city is severely understaffed in this regard, and they cannot take sound readings when they need to.

Waid's is loud. Really loud. Not always, not every day. But on some nights I've literally heard the doors in my apartment vibrate on their hinges due to the intense reverberations coming from Waid's. I've lived next to bars before, but nothing comes close to the level of noise we hear from Waid's. If he truly did soundproof the building, he either hired an incompetent company, or he's compromising the soundproofing in some way, e.g. leaving doors open.

You obviously haven't been at Waid's on a loud night. Don't dismiss our voices just because you went there once and it wasn't that bad.

I have tried for months to get sound readings taken at Waid's, and in half a year I managed to get 1 reading. One. And it was on a Saturday, a day that is typically quiet at Waid's, because even though I insisted on a Sunday reading, I was told that the city doesn't have the manpower to take readings on Sundays. So that's why there's no sound violation. We can't get the city here on the loud nights to actually take the reading.
2
No quote from Vickie, the black homeowner who was also at the EastPAC meeting, and who has suffered from Waid's far longer than any of us? Why not? Because it doesn't fit your narrative about racism and gentrification?
3
I love Waid's. Great food, the pillow pit, and the happiest staff. It's a treasure.
4
I'd like to know where there AREN'T blatant drug deals in populous areas of Seattle. Pike Place Market? Check. Target on Second? Check. Bus stop on third? Check. University Ave? Check. Etc., etc.

They're clearly singling this guy out.
5
So they should get a break that no other club would because they're cliental is mainly black and seems to have a violence problem?

6
they're cliental = their clientele
8
Willing to bet Waid's already existed when 95% of these whiny fucks decided to move in next-door.

It doesn't work like that: you don't move next to a farm and then complain about the animal noises and smells emanating from your neighbor's property.
9
@8

Willing to bet that some mossback is still mad my wife bought her place on cap hill when I was still in middle school 20 years ago.

Point? Everyone thinks the last person in should STFU and not touch anything, practical or not.
10
I don't really care about Waid's one way or another, but I live close by and would rather not see another building get razed in order to accommodate the increasingly tentacled grip of Seattle U. I do have a friend who moved out of the apartments adjacent to Waid's due to sound issues, so that probably sucks. However, blaming all the violence in that neighborhood on Waid's seems a bit off. Thanks for the article.
11
Honestly, the real problem with the 12th & Jefferson area is that the #3 and #4 bus route goes right through there.

This is the main thoroughfare from which thugs and dealers get from the CD to the downtown area.
12
That's been a high crime area for decades, like University Way, Pioneer Square, First and Pike etc. Take away the night club, you will still have crime.
13
When I worked at The Cuff in the 90's, some old bat cost the owners a lot of money by raising a stink about noise.

The patio at Manray was basically unuseable after a certain hour because somebody complained in the apartment building next door.

The Oak on Beacon Hill almost had their liquor license refused because somebody anticipated that it would be too loud, and that there might someday be too many places in the neighborhood that served liquor.

I don't think it's a race issue. It's a misplaced suburbanite issue.
14
@9 I've made my point. You don't see it and that's your problem.

See #13 for further eloquent clarification of my argument.
15
Make a better point than "New people need to acquiesce to the status quo or stfu" for me to get.
16
Sounds like Mr. Sainvil is a nice guy. It also sounds like he is a terrible neighbor. Whether a resident has lived in the neighborhood for six months or sixty years is completely irrelivent. As is the color of their skin. Property owners and residents have a right to expect some peace and quiet while they are trying to sleep and to not have fistfights and gunfire erupting outside their homes on a regular basis.
17
I am 63, white, from SC. I have spent very little time in Seattle, so I really have no right to comment; And my comments are based on soley on this article. I call BS. Waid's is a good neighbor. Go after the criminals, not a civic minded peaceful bar owner whose business attracts predominantly black clientele.
18
Has anyone pointed out that there is a methadone clinic on the corner of 12th and Jefferson as well? Recovery Centers of King County, aka RCKC.

This is the same clinic that got into hot water a few years ago for (something along these lines) registering their business twice using the front door and the back door as 2 addresses, so that they could (illegally) serve twice as many people as the law allows.

I am not pointing fingers and have the utmost respect for RCKC ("the last house on the block" for a lot of addicts) and people in recovery, but it does seem relevant to the discussion of the neighborhood as a whole.
19
I lived down the street from Waid's maybe 4 years ago. Walking by there at night was a harrowing experience. There were always a bunch of young guys standing out front harassing people, and some nights there would be shootings. Having lived there, it was apparent that those guys were simply a fixture of the club. It's not the best area but walking by Waid's would make your hair stand on end more often than not.

I'm sure it's a funky place on many nights, but the fact is a criminal element is attracted to hanging out at/in front of the club. It's really easy since it's a black-owned club to say this is just white gentrifiers wanting black people to not have nice things, but it's also incredibly disingenuous. Many of us would love to have MORE black owned businesses. It's just unacceptable to feel like you're going to get robbed or shot every time you walk to the store. I feel for these residents even if some of them are 'gentrifiers'. Except for that one lady who said he's 'killing his own people'. That's a pretty weird statement,
20
There was a hearing that Waid blew off last week. Anyone know why? It was in regards to the selling of narcotics (not marijuana) to undercover officers. Also a sale of narcotics to an undercover officer while he was standing by Waid. I wanted to hear his side of the story.
22
I was wondering if The Stranger could do an interview with Waid about the short version list that was on CHS Blog in February? So we can hear more information besides "it's a race thing." My mind is open.
http://www.scribd.com/doc/209601369/Waid…
24
@22 It sounds like that's all the guy has, which is unfortunate. What he could do is make serious efforts to discourage aggressive and violent behavior in- and outside of his club, in order to make the nearby residents not fear for their lives when walking by the club. (As I said before, I lived a couple blocks from Wade's and it was terrifying walking by there most nights)

Unfortunately, he seems really stuck on the idea that if he screams 'racism' loud enough, he'll get sympathy from everyone who has no idea what it's like to live nearby. The idea that anyone wants to get rid of this business because it's owned by a black man is laughable. The residents just want to walk by the club without being shot at. It's really simple.
25
After those terrible articles about the Cody Spafford bank robbery/shooting, I can't help but wonder if the author has left out the most persuasisve reasons that the city is trying to shut this place down. Something along the lines of @ 20...?
26
The narcotics that SPD keeps bringing up is pot. Tell me anyone in Seattle except SPD care about pot, really? Every nightclub in this city has drug trafficking. Every bartender, owner, and security guard know who to ask for anything, whether they want to know or not. So an undercover cop goes to a reggae club, asks around for pot, and found some. BIG FUCKING DEAL. There is a bar a block over that is a known gang racket with crack sales in the alley. Gee, do you think that might contribute to violence in the area? But that alley spills out in front of Waids, so it's Waid's problem? Oh hail no.

Unlike Waid, I don't think it's a race issue. But a few people in the city attorneys office and SPD have a stick in their ass about Waids and are using cherry picked stings that could happen anywhere in order to drive him out. They need to find a bar more worthy of their attention, I might suggest they ask the attendants at the Rainier Club where to score some coke.
27
@26 They have a stick up their ass about Waid's because the patrons pose a threat to the community in the form of violence, shootings and aggressive behavior. When they shoot someone outside the club, you can't ticket the owner for that. But it's clear the club and the clientele it attracts are the problem, and the club isn't doing anything about it. How can you not see that this necessitates a different approach?

You know, like if you're a mob boss for 20 years, you don't get locked up on "mob bossing", they just eventually get you on tax evasion.
28
The junkies are pretty well cleared out by 2 and 3 AM. I've never seen them after hours from the clinic's closing.
29
It's a great club. Peaceful, friendly. One club I feel safe taking my girlfriend to. Never a problem there.
30
RAGE!!! I live 3 blocks from Waid's, what "shootings"? What "fights"? The sirens that keep me awake at night are consistently being called on drunk college kids living in the new condo hi-rises around Seattle U. The fights I see are on 12th and Jefferson on Sunday afternoons because the dudebros can't handle their bloody marys. The worst noise is coming from Von Trapp's on Saturday night and if you want to see underage drinkers just walk past the front door. These complaining "neighbors" sound like a bunch of racist assholes.
31
@30 Shooting this past weekend,April 20th on Sunday/Monday Reggae night. Bullets hit building on the East side of Waids and went through someone's bedroom window on the West side of Waids.
I don't believe the shooters would have been there if it were not for it being Reggae night at Waids.
32
The hipsters and gentrifiers complaining are using an AGE OLD tactic to attack black businesses and places of gathering.

Lie with a stereotype.

Ive lived in cities and towns in half of the country, and Ive seen this time after time by gentrifiers and law enforcement.

If you move into a majority black (or hispanic) area and generally feel afraid of black or hispanic people, harass them by begging the city and law enforcement to crack down on them by lying.

"I cant stand all the rap music and gangerbangers shooing up the neighborhoods" (when there are fewer shootings there than majority white downtown areas or suburbs).

"I dont feel safe outside" (because you equivocate black/brown people with criminality)

"I was almost robbed the other day by a group of thugs" aka you walked past more than 2 black or brown people minding their own business and youre racist mind was scared shitless.

Ive seen this in cities all over. Orlando, Portland, Austin, Saint Paul, Las Vegas and now Seattle...and its not new either. Bigots were doing it in southern cities like Asheville, Charlotte, Memphis, and Nashville back in the early 90s.
33
@gatecrasher

Im clicking your handle and noticing all your comments revolve around defending racism, or attacking those who complain about discrimination.

Im also noticing that aside from this comment, no one is responding to you, yet you continue to spew your viewpoints and beg other readers to react to you.

Is this a hobby for you or are you getting paid to do this?
34
I've been to Waid's quite a few times. I've never had a problem. Sure I've seen fights and other altercations break out but, I've seen the same at other venues around Seattle. Venues where patrons were primarily white.

Go out for a night of dancing or what have you in Capital Hill where the LGBT community can't enjoy themselves peacefully for fear of being tormented by the BroFrat dudes. Like one of the previous posters stated, on a Saturday night, Von Trapp's is ridiculous. The noise, the excessive amount of drunken fools stumbling out of the place... It's becoming a real problem. It's even spilling out over to Bellevue. The only one side of it though. It's not a black, white, brown, or yellow thing.

Honestly, it's to the point where I don't feel safe going out anywhere around this city. Being of West Indian descent, I feel like I have to constantly look over my shoulder in Cap Hill or Bellevue because, some young student bro has something to say about me having a white lady friend. If I'm in B-Town or Pioneer Square, I have to pay mind to the venues I step in and out of for fear of being shot by the black guy across the club, who felt he was shorted on his bag of weed and is now pissed off at the world or, his girl had something to say about mine and I took offense to it.

Truthfully, it's not the venues problem but, they can do a few things to help possibly alleviate some of the issues. Use metal detectors in addition with searches, use reputable security services, build within the community (SPD, neighboring residents, the patrons). Set the standard that those whom want to conduct themselves in a manner comparable to an imbecile will absolutely not be tolerated and dealt with to the laws highest extent.

Obviously, you can't prevent all of the bad happenings but, if there's no community (which includes everybody), there's no hope.
35
"Is Racism a Factor?"

No.

It doesn't matter what color the owner of a bar is when they serve people with fake IDs, serve people who are overly intoxicated, direct people to drug dealers, and bring a continual noise and violence issue into the neighborhood.

It also would not be the first time a club has found it necessary to discontinue a theme night due to community issues.

Get over it Waid, cry racism all you want but the fact is these are issues faced by every club and bar in Seattle. You just chose to not accept responsibility. Now it will be forced upon you.

If you're really a community guy then you will understand - community is not an excuse to become a neighborhood blight.

And fuck you for playing this race card bullshit.
36
"when I walk there, I can hardly hear the boom-bap of the hiphop and reggae until I'm a half block or so away." --- when you're not half a block away --- as in next door, you can hear the boom-bap really really well, especially in Summer when the doors are open.. And you can hear it really late, and all week long --- a and the patrons are loud -- and yes, there's the fighting and shooting. Not great for the neighbors, who aren't all affluent or white.

A club has NOT been there forever. It was a grocery store before it was a club, and except for the new buildings on 12th and Jefferson, the residences were there before Waid's opened. Time to close the place and let the neighbors get some rest.
37
@ 35, see @ 30. The racism isn't in the city's response necessarily(in my opinion), it is the people who call the cops and freak out when they see young black men loitering outside a club or fighting outside a club. But they don't have the same reaction when the same thing happens but it is white frat guys or whatever.

It is pretty clear from the undercover operations that they purposefully serve underage patrons (or at least are woefully negligent in preventing it), and that alone justifies the city's actions. And plenty of other bars lose their liquor license for the same thing. But, with regard to how many 911 calls are made, you really have to wonder if that is because it is so much worse than everywhere else, or if it is because people are so much less comfortable with the type of music and the way the people coming and going look.
38
This is clearly racism on the part of neighbors and the city. Waids is great.
39
@37 "because people are so much less comfortable with the type of music and the way the people coming and going look."

Leaving aside your characterization of nebulous "people", how to examine that in a race neutral manner?

http://www.liq.wa.gov/records/public-rec…

is certainly a possibility. Is it too much to hope for that the Stranger writers would put down the yellow journalism for a moment and give us some relevant comparisons? Von Trapps maybe?

Is there some reason the Stranger decided to run with a race baiting opinion piece rather than a substantive work of journalism?

And does Seattle, or any city anywhere need to keep a disruptive business open just because of the skin color of its owner and/or patrons?

Do you believe the city would allow a white owned, white patron club to remain open if they had a track record similar to Waids?

Leave the race card out of this. No matter which way you slice it, it's bullshit. Waid had his chance to be a real community positive force, and he's taken a shit on that chance to keep money flowing into his pockets - regardless of whos window the bullets fly through.

That disregard for the community is why this is happening. Not because "people" don't like reggae or blacks people, but because people don't like violence, gunfire, and liquor violations.
40
This ish is ridiculous. It's sad to sit by and see the amount of heightened scrutiny that has been placed upon Waid's. When stepping back and looking at the big picture, when you weigh a man's character, his efforts and the measures he has taken as a business man and one who has given great respects to his community and in efforts to appease cause for a greater good within the neighborhood and within his establishment, few other bar/lounge owners can be brought to comparison. But perhaps that is the point, heightened scrutiny put under a microscope and public ridicule are just that... You can't place the blame on someone trying to do good and create a conduit for a diversity of cultures to mesh as the basis for crime that occurs in an area. On the contrary, there are a dozen + venues in the city where violent and high drug activity are a commonality and where SPD may be somewhat often present there I have yet to hear any news of their liquor licences being weighed in the process. Club Nectar in Bellevue square was shut down following a fatal shooting that transpired in the club by an under-aged gunman who allegedly illicitly gained entry by potential staff.... Simple truths in our society should be simple enough to understand, you can not control the actions of people and as such in turn should also not try to over control or punish the efforts of the few attempting to create environments that attempt to deter illicit and violent activities. The truth of the matter at Waid's is that the city, some local municipalities and some predigest ass individuals are looking at the wrong person to point the blame at and for a scapegoat to be sacrificed as means to exhibit efforts towards addressing compounding community issues that have no merit in their attempts and in fact perhaps the exact opposite. Dare to educate yourself and stand for what is right in the true face of a greater good. #Truth
41
Waid's is great, as is the man himself. He's not the problem.

The problem is 2-fold: the rich, bible-thumping "legacy" that went to, runs, and wants to live near Seattle U (without having to see people of color), and the East Precinct SPD, who does its best to service them with kid gloves while ignoring the rest of the neighborhood.

Fuck both of those organizations with a large, splintered bat.
42
The city's document cited by @22 conveniently wasn't linked to by the author of this article, who instead chose to minimize and mischaracterize the complaints.

Mr. Herz, you have zero credibility. If facts don't support your opinion you simply leave them out. How about you give us ALL the facts and trust us to draw our own conclusions? That would be honest journalism.
43
@42

I'll put another link to that letter, it really sets the stage for this article. Well done #22 Amir, you are a better journalist than Mr. Herz.

Notice that on the compliance checks (underage people sent in with obviously fake ID's) it is noted that they took those kids to multiple locations. Waid's wasn't "singled out".

http://www.scribd.com/doc/209601369/Waid…
44
Some interesting thoughts in your article,
Ansel Herz. But can there be racism against people who -- in essence -- don't have a race? 99.9% of so-called blacks piggyback on the identities of Caucasians (Anglos, Spaniards, French, and Portuguese). Oh, and on Arabs. None of these Caucasians and Arabs identify as black.

In fact, the only true Blacks were in that crew -- including my ancestors -- who touched these Western shores in slave ships; the rest, throughout the world, have been glorifying the identities of Europeans and Arabs for centuries.
45
I was born and raised in BLV/Seattle. I've since lived in Boston (Allston) and now I live in North Philadelphia in the Kensington neighborhood. My opinion is that most people in Seattle and the eastside really like QUIET and safety. it's just the culture of the city. In a loud city like Philly the tolerance is way higher for scary people and loud music/yelling. I don't even know what "white" means anymore. I guess it refers to light skinned people who went to college. In general that class of people prefer quiet and safety, but again, especially in Seattle. Maybe it's that Scandinavian blood? When I come home and come to a cafe it's just a bunch of heads over their ipads. I've been shushed on the bus in Seattle! Anyway, I figure there's gotta be a city for quiet people so why not Seattle? I moved to philly and I'm much happier.

46
The sad thing about Herz's intentionally incomplete and biased reporting is that there is likely a real stoy to be found here and racism probably is a factor, but few people will take seriously a blogger who is so obviously trying to mold the story to prove a point.
47
@ 39
Do you believe the city would allow a white owned, white patron club to remain open if they had a track record similar to Waids?

That is the question. And it is exactly the question the stranger article is asking. Like I said earlier, the purposefully/knowingly serving underage patrons seems like enough to justify the city's actions. But the question is, do they try to revoke the liquor licenses for other clubs for just that reason reason alone? If not--if they only persue actions like this when there are also complaints and 911 calls--then you really have to wonder how many fewer 911 calls there would have been and how much less the neighbors would have blamed on the club if the patrons were predominantly white...

You must know that people in this country/city are more likely to call 911 when they see young black men loitering or fighting than when they see white frat-looking guys doing the same?
48
@ 46 - Yes. This isn't quite as bad as his reporting on the police shooting. But it is still pretty obvious bias, and it makes you wonder what he left out. A good story always should start with an accurate representation of the facts, something Herz seems incapable of when he is trying to make a point. If you are sloppy with the facts to the benefit of your argument, then it undermines the whole thing. And:
The city's latest arguments to the liquor control board are based on police reports alleging a series of low-level crimes—including $10 and $20 sales of marijuana and serving alcohol to minors—that took place in or around the restaurant. None of the alleged crimes directly involve Sainvil.
is not an accurate and unbiased account of the facts. It leaves out the fact that the underage minors were actually undercover officers with obviously fake IDs, not an occasional underage person who sneaks in or has a very good fake ID or something. It also neglects the fact that the clubs employees were directly involved in the drug sales and that some of them took place right in front of the owner. A good argument aknowledges and deals with the other side's best points. A bad argument pretends they don't exist.

I don't think any of those facts would have been fatal to the point Herz was trying to make, but ignoring them is certainly fatal to his credibility.
49
@45:

My opinion is that most people in Seattle and the eastside really like QUIET and safety. it's just the culture of the city.
*********************************
THIS. I grew up in NY State and can say the same: this is a quiet corner of the US that draws people wanting nature, peace and quiet. In NY State, people are much louder, outspoken, etc.

I have taken friends from Texas to Seattle beaches in the summer; they noted how quiet the beaches were - in Texas, everyone has competing boom boxes of some type, there are loud drunks...

And, I too have been shushed on a morning Metro bus ride - apparently, it needs to be "hear a pin drop" quiet.

WHY are there apartments so close to a nightclub anyhow? I thought zoning laws kept some distance between night-life businesses and residential?
50
You must know that people in this country/city are more likely to call 911 when they see young black men loitering or fighting than when they see white frat-looking guys doing the same?
**************************
Frat boy = entitled, "above the law" asswipe. You bet I'd call 911 on the little fuckers as that demographic includes budding psychotic politician-wannabes that need a slap down.

I KNOW THAT SAINVIL IS NOT RESPONSIBLE FOR OTHER INDIVIDUALS ACTIONS. WE LIVE IN A SOCIETY WHERE ANYTHING GOES, AND JUST BECAUSE OF THIS THAT DOES NOT MAKE IT RIGHT OR JUST. The vast majority of these noise complaints come from one resident who lives on E. Barclay Ct. She has been calling in noise complaints for years for everyone, Waid's as well as anyone who is having a bbq later than 8pm. As far as the drug busts and serving minors go, SPD targeted Waid's in an attempt to shut them down on drug and alcohol violations because they couldn't get them on anything else. The issue from the city's perspective is that there was been multiple homicides, assaults, and other violent crimes linked to Waid's patrons. How the city can tell Waid's patrons from those visiting the Blue Nile--another bar linked to violent crime and the past three shootings at 12th and Jeff--is anyone's guess.
54
Everything is always racism. The fact that serving alcohol to minors and playing that "music" so loud it busts your speakers is against the law (and is against a lot of other things) has nothing to do with RACISM. Also, I've heard them sling the term "gentrification" around before. Spike Lee used it once. Gentrification only means fixing up the broken down homes and raising the value of the neighborhood... they think it means fixing up the neighborhood to move them out. I don't even live in Seattle and this pisses me off because the supporters of Sainvil obviously have to cry racism and can't deal with it intelligently or say, "Hey we're sorry; I'll fire the bartenders and waitresses that serve alcohol to minors and turn the music down." Come on!
55
@51 ... ALL CAPS AND NO PARAGRAPHS ARE BAD M'KAY.
56
@55 People that use "M'KAY" in comment sections are usually conceited elitist assholes. M'Kay?
57
"conceited elitist assholes."

ILLETERATES AGINST ELYTISM!
58
@54: I'm not going to argue about whether racism is a factor in this story. I am going to say that you are mistaken about gentrification. It's not just a couple buying a home in a poorer neighborhood and fixing it up. It's about a whole bunch of people doing that, developers coming in and doing that wholesale, and pricing long-time residents out of the community. It's a common cycle, and there are some people who lose out when it takes place. It can be argued whether city government should try to moderate the process--and if so, by how much--but they shouldn't be actively forwarding it.
59
Actually, I didn't specify whether it's a couple or the government fixing it up, however, I looked up the definition again and it is the fixing up of a home in a lower-class or urban neighborhood by an *individual" (a couple, as you stated) and not by the government as I previously thought although I didn't specify. So, my friend, you are the one that's mistaken.
60
Gotta love it when privileged people who dont suffer from racism tell minorities "No its not racism, its just how it is...that people like me always focus on shitting on people like you!".

Its like a man telling a woman what pregnancy is like.

Sure bro...tell me again how you know from experience!
