"Twice-deported illegal immigrant accused of raping young girl in Oregon"

egal immigrant -- who posted bail the same day he was charged with the rape of a young girl in Oregon -- is now in the custody of immigration officials, federal records show.

Seaside police arrested Guatemalan national Anastacio Eugenio Lopez-Fabian, 24, in February after investigators determined he had sex several times with a girl younger than 14, the Daily Astorian reported Monday. He was also charged with assault and harassment.

Lopez-Fabian was released the same day he was arrested after he was able to post $25,000 bail. U.S. Immigration and Customs Enforcement detained him March 7 at a courthouse parking lot prior to a scheduled hearing.

Lopez-Fabian is now in custody at a detention center in Tacoma, Wash., according to federal records.

“Hours after his release, ICE deportation officers received information from federal databases about his prior immigration history and his most recent arrest,” ICE spokeswoman Carissa Cutrell told the Daily Astorian. "From there, they conducted an online review of jail and court records and determined that Lopez-Fabian did not have lawful status in the country, and subsequently, targeted him for immigration enforcement.”

Lopez-Fabian had been deported in 2013 and 2014, Cutrell said.

Cutrell criticized the Clatsop County Sheriff’s Office for not alerting the agency of Lopez-Fabian’s arrest.

There is obviously nothing unconstitutional about asking someone if they are a legal immigrant.

So while Ferguson and others have to sue for name recognition and general political reasons, they know that at the end of the day this is a stalling tactic. Politically aligned courts may rule in their favor, but eventually it will end up somewhere not politically friendly where the court will rule based on its actual constitutionality.

Look up how often ninth circuit decisions get overturned to see how this plays out in other cases.

It is fine to be against the question on the basis of not wanting democrats to lose seats and votes they depend on from illegal immigrants, but don't pretend that this is a constitutional question. It is 100% political on both sides.

No, dumbfuck. The question hasn’t been asked for over 60 years because of factual accuracy. This wasn’t decided by democrats. It was decided by scientific fact.

The government has to have accurate census numbers. You HAVE to as accurately as possible who lives where and what services are being accessed. You can’t run a country on fantasy. Although the Right in this country believes so.

The electoral distribution is already heavily over weighted to the failed meth and opiate addicted Red State shit holes who are losing population and suck from the government welfare teet without paying into it. THAT’S political.

We also HAVE to have an accurate count of who is here legally and who is here illegally.
Because of factual accuracy.
And scientific fact.

Frankly, if the illegals expect us to ignore our laws to accommodate them but they are unwilling to co-operate with something as basic as the census then we are left with no option but to deport, sooner than later, starting with the dreamers.

I used to work for WDFW collecting data related to fishing. We were told not to ask for the persons name or anything related to licensing. The thinking was that if the fish was caught illegally the person would not talk to us or would lie to us. In order to manage a fishery you need the best possible data to make decisions with. Our job was to get the data in order to manage the resource in perpetuity and let the game wardens handle the enforcement issues. Do we really want a big portion of the population to not answer these questions? How is that going to help any planning process?

Spot on.

Not to menrion this sort of thing creates a climate of fear among immigrant communities (which I think is the point of it). This leads to folks being afraid to interact with law enforcement or report crimes, access needed services, or even come out of their homes. Is increased poverty, crime, and marginalization really what we want for our communities?
