On Wednesday, US District Judge Emmet Sullivan ordered the government to return asylum seekers deported under former Attorney General Jeff Sessions's immigration policy, which denied them the right to claim gang violence and domestic abuse as adequate grounds for requesting asylum. According to Buzzfeed's reading of the opinion, Sullivan found that Sessions's rules contravened the Refugee Act, the Immigration and Nationality Act, and the Administrative Procedure Act.

"Because it is the will of Congress—not the whims of the Executive—that determines the standard for expedited removal, the Court finds that those policies are unlawful," Sullivan wrote in his decision.

The DOJ now has to return the plaintiffs represented by the ACLU in this case—that's twelve asylum seekers and their children— and give them new credible fear hearings. And starting today they can't deny people asylum for only suffering brutal violence at the hands of gangs and angry husbands.


Judge Sullivan was also the guy who said he couldn't hide his "disgust" and "disdain"for Michael Flynn, a former paid foreign agent of Turkey who lied to the FBI about his contacts with Russians during his time as the National Security Advisor to Trump. During the sentencing, Sullivan forced Flynn and his counsel to admit that they all knew it was illegal to lie to the FBI, deflating arguments from the right suggesting that Flynn had been entrapped by law enforcement.

Sullivan was also the guy who ordered the government to turn around a plane that was carrying an El Salvadorian woman and her child who'd been deported in the middle of their hearing, saying, "This is pretty outrageous. That someone seeking justice in U.S. Court is spirited away while her attorneys are arguing for justice for her? I'm not happy about this at all. This is unacceptable."

President Clinton nominated Sullivan to the Federal bench, but before that President Ronald Reagan had appointed him to the D.C. Superior Court and President George H.W. Bush had appointed him to the D.C. Court of Appeals. He went to Howard University for a political science degree and his law degree. (Famous alums of the historically black university include Toni Morrison, Ta-Nehisi Coates, Jelani Cobb, Zora Neale Hurston, Supreme Court Justice Thurgood Marshall, Senator Kamala Harris, and Puff Daddy, who went for two years.) In short, Sullivan is a wise and good judge and I wish him a long career in federal court.
