On the CNN town hall, I find myself in the uncomfortable for me position of agreeing with Raindrop. The man can’t keep from incriminating himself and opening himself for more defamation lawsuits any time he’s at a microphone. And while his antics improve his chances with his base, they’re going to turn off the other 70% of the country. I would like the town hall folks to turn off his mile if he starts talking over the moderator.

Happy for the Cinerama. Sad to see it all boarded up like that especially after all that dough Allen spent refurbing not too many years ago. The last movies I remember seeing there were “Apollo 13” and “Red Dragon.” Always was super-chilled inside which was nice on a hot, summer afternoon, but the carpeting had seen better days. I remember people turning out for its re-opening – a 70mm restoration of “On the Waterfront,” and of course, those 24-hour lines when “Independence Day” opened. That was something. Reviving downtown movie houses hasn’t been terribly successful in the past (remember UA 70 & 150?), but this is kind of bigger than those and the Cinerama holds a lot of town affection. Very best wishes.

@25 - Well, I've been extensively trained on neck restraints, as we used them in Dallas PD up until 2009 or 2010 or so. He appeared to apply a properly placed vascular restraint...which is what we used...but he held it wayyyyy too long. The restraint needs to be released the second the subject loses consciousness, not well after. Holding it that long after loss of consciousness is just begging for a bad outcome.

And it IS reckless. If you're going to use it, you better know how to use it properly. I used it regularly whenever anyone resisted, because I was built for it. Tall and lean works best. Short and stocky cops usually had difficulty getting it to "take" for them. When applied correctly, it causes 15-20 seconds of unconsciousness, more than enough to apply handcuffs without further trouble. Hell, well over half the time, the bad guy would freak and give up just from the pressure well before losing consciousness.

Anyway, if I couldn't get the hold on properly (not always easy when the person is frantically fighting you), I always abandoned the effort and either tried another tactic or tried the hold again from a more advantageous position. I refused every single time to apply it improperly, however, as would any half-responsible cop.

When applied properly, we had a well-researched study that found it was safer than using a Taser. But Tasers look techy and they're not in contact with the subject (except for the darts), so the public approves of them. It wasn't the hold itself that got it banned from most every department in America; it was improperly applied holds.

This hold was improperly applied, in that it was not removed as soon as the man lost consciousness. The hold that killed Eric Garner was also improperly applied, in that it was the very dangerous bar-arm hold and not a vascular neck restraint.

Given how irresponsible and reckless it was of him to continue the hold well after the subject lost consciousness, I don't think a low manslaughter charge is unreasonable. You're probably right about a jury not convicting, however, given public fear of subway crime. The experience of being tried may make him more circumspect about living out his MMA fantasies on the public in the future, tho.

It's not hard, really. If you don't know how to use a restraint method...any restraint method...correctly, don't use it. Especially don't use it when even correct use involves depriving the brain of oxygen (blood), thereby increasing potential consequences if you screw it up...unless you're certain you know what you're doing. If you're not proficient in the use of a hold that can cause death if something goes wrong, don't use the hold. It's as simple as that.

I always assumed if I killed someone unjustifiably, I would end up in the dock. Of course, that was unlikely during my time as a cop, but I assumed it anyway. Anyone intervening in situations such as this should assume the same. It may make them less reckless with their actions.
