Broadly, the Miranda warning advises someone in custody and under interrogation (both necessary elements) that they have the right to remain silent and to an attorney, and that anything they say will be used against them. Even if someone somehow has never seen a police procedural in film/television and isn't aware of those rights, failure to warn only means that a statement the person made while being held and questioned can't later be used at trial. That's it. Can we finally end this ridiculous myth that the Miranda warning is some magic spell that, if not uttered, invalidates an entire criminal case, like failing to phrase your Jeopardy answer in the form of a question?

@6 You just defended throwing an 80-year-old woman with arthritis in a cold jail cell for a harmless offense, and what's more, you used the Nuremburg "I was just following orders" non-excuse to do it. Any human being with empathy would be so ashamed and humiliated to say what you said out loud in public. I feel sorry for you and I hope you decide to exercise some decency moving forward.

That's my tiny hometown and I was pretty shocked to see someone I know in my other (much bigger) hometown's paper. I'm not surprised at all about the Clare County cops--they're the ones who made national news with their stupid revenue-generating donut shop, Cops and Donuts, a few years ago. Everyone laughs at how cute and self-deprecating it is, but that department is known for cracking down hard on people like Delores and generally lacking empathy.

Yeah! She broke a law. She should be held indefinitely with no representation. Her family should also be held indefinitely without representation in unsafe conditions with no way to communicate with her. That'd teach her not to break a law!
