Barrett's confirmation was always going to happen. The Republicans will squee with glee (Mitch McConnell will be giggling some more) and they will think they won something. They are not going to like what happens as a result.

These extremest outliers really don't understand that people in this country, the MAJORITY of people in this country, including people who call themselves (or used to call themselves) Republicans like things like having healthcare and support a woman's right to choose when it comes to abortion. Republicans get abortions. Republicans get sick and require healthcare. Republicans like all sorts of things this administration and this GOP led Senate have packed the SCOTUS in order to dismantle and destroy. Confirming this unqualified and bigoted woman to sit on the court will not stop people in this country from fighting for their rights and it will not stop people in this country from obtaining abortions or anything else Gorsuch, Kavanaugh, Barrett and the other cons on the court choose to eliminate from the rights of the people.

Is it going to fuck shit up and cause problems and kill people? Yes it is. And that is not to be taken lightly. We're going to go back to dead women trying to get backroom botched abortions. More people will die because they have no healthcare (including the nearly 10 million, but who knows how many actually, who will have the pre-existing condition of having had COVID-19 and all of the health problems it causes).

In the long run, however, are they going to succeed in turning this country into some sort of theocracy run by religious zealots? Nope. All they have done, as in everything else this administration has done, is motivate people to fight harder, fight longer, fight stronger, and demand more from their elected officials. In fact, they've inspired more people than ever to run for office at all levels of government than ever before. They've inspired more people than ever to vote than ever before. And if and when the time comes that the GOP has been permanently put out of power, Congress can do plenty to counteract the damage of a partisan hack meaningless reality show of a SCOTUS by putting into place permanent legislation that protects people's rights. Period.

Of course Barrett was going to be confirmed. McConnell creamed his pants as soon as he heard RBG died.

But Roe's not the thing to worry about. The point of packing all the courts around the country is to transfer more wealth and power to the wealthy and powerful.

What will be the result of an ultra conservative bunch of courts and judges around the country? An even greater divide between the wealthy handful who control everything and the rest of the country who scrabble for the table scraps. White men keep voting for that shit only because their wealthy owners allow them to be first in line for the scraps.

This country was fucked the day it was founded by a bunch of wealthy, white landowners who didn't give a shit about anyone but their own little privileged, private country club. It's only gotten worse since then.

When KkKonnell failed to install ANY of Obama's pick for Federal Courts, KkKonnell was Packin' the Courts. When KkKonnell FILLED all those empty (for fucking ages) seats with highly UN-qualified far right Activists, That is Packing the Courts.

Expanding the courts may be Required, or, as others have suggessted here, a Dem Congressional Majority can alleviate much of the extremists's Activism with a little preemptive legislational court-bypasses of their own.

Income taxes are constitutional, they just have to be a flat income tax with one deduction. Only one. It could be the federal deduction, or just a $15,000 deduction, whatever. Can't be a mix. Nobody cares what your arguments are, but it's constitutional in this state if it's exactly that.

Contemporary packing of the federal judiciary began in 1993, with the GOP claim that Clinton, elected with less than half the popular vote in a 3-way race, was not a "real" POTUS in the traditional sense and was thus his judicial nominations were not entitled to the traditional deference. (Time was, you had to be seriously dim or seriously shady to be rejected by the Senate.) Many of WJC's successful appointments were compromise picks, and many seats were left unfilled at the end of his term.

This principle clearly did not apply to GWB, who also lost the popular vote, and the open seats were packed with Federalist Society ideologues.

Obama was elected in a landslide, but by this time the argument was "because we can", and many, many seats went unfilled, opening the door to (popular vote loser) Trump's record number of appointments.

@38 That's not what happened with FDR. Maybe somebody complained - I wouldn't know - but the reason the project never went forward is because the Supreme Court all-of-a-sudden decided that maybe the New Deal was constitutional after all. Which is to say, the court recognized that to protect its "legitimacy" (i.e. power) it would be unwise to provoke a president who's party had overwhelming control of Congress at the time. So FDR got his way and "court-packing" became superfluous.

Its simply absurd for Republicans to shed crocodile tears about norms. Mitch McConnell does what he does because he has the votes to do it. There's no reason the same principles shouldn't apply to democrats. GOP is just mad because they spent 30 years setting this thing up and now they see somebody coming right at them, knife in hand, to cut their Gordian knot.
