You know, they (the democrats) could be demurring on that question because they fully intend to pack the courts but don't want to give the republicans any last minute ammunition to get republican voters frothing mad.

Advocating for court packing now is likely to galvanize conservative voters in the upcoming election, and it's not like liberals need any more encouragement to vote against the incumbent. Staying noncomittal on this issue for the next 6 days is the only approach that makes any sense. This was a poorly thought out post. .

This seems like a pretty clear cut and true statement. Court packing would be within their power if they have majorities. There is no benefit for the Democrats to play their hand while the GOP still controls the Senate. I'm not saying I believe they have the courage to pack the courts, but I dont fault them for not openly saying that's what they are going to do.

I concur with the above commentariats: if Dems say they'll 'pack' (meaning: UN-fucking Pack) the Courts it gives the Holier-than-YOU, motherfuckers a REASON TO Vote. and why give them more ammo?

Expand the court, like AOC says, not pack the court, which is what the Republicans are doing now. Don't use their language; adopting it puts you on the defensive, like you're conceding you're doing something wrong.

Why show their hand?

Assume, if you want, that Murray and/or Cantwell is totally down with expanding the Supreme Court. There is absolutely nothing to be gained by publicly taking a position on it right now. Neither is up for re-election this time around, so it isn't an election issue for either of them. It obviously isn't going to get voted on until after next January, and only if Biden wins and the democrats gain a significant majority in the Senate. If either of those things fails to happen, it's completely moot. The smartest answer for either of them right now is "meh, we'll see. I'll think about it."

I'm not the least surprised you didn't get much of a satisfactory answer from them.

No… UNPACK the courts. The courts right now already have been packed… by the GOP. Unpack them by expanding them as needed to undo what a broken and undemocratic system (as well as no shortage of Democratic Party incompetence, but I digress) enabled.

Don’t accept the GOP’s rhetoric. Redefine it. Take ownership of the narrative for once.

I'd be surprised if Dems go down this road for the reasons stated by @7. There will be too many moderate dems that sit in flippable districts that won't be willing to spend all of their political capital on something the majority of Americans will probably be against. If you also consider Biden's other priorities of raising taxes, expanding the social net, invoking new environmental regulations, changing immigration policies among other things what takes priority. When Obama took office the dems controlled everything and had an overwhelming mandate to evoke change and they shit the bed. I'm sure what's left of the Repub party in 2021 would love nothing more than to draw them into an "expanding the court" debate. While they are at it maybe they can invade Russia in winter.

Democrats are pretty abject when it comes to not standing up to Republicans: they think it makes them look "partisan." For the last 40 years, Democrats insist on standing in the middle even as Republicans keep pushing that middle to the hard authoritarian right.

How did Republicans pack the court? Are you guys just changing the definition of packing the court?

Its definitely a risky move and I don't see it happening, you'd lose the Presidency at some point and Republicans would just add the equivalent number of judges.
