I completely agree with this mandate, though I'll be curious to see how they explain calling it a "nondisciplinary dismissal" when someone challenges their sacking in court.

Imagine calling yourself the greatest country in the world and the only way we're ever going to get to full vaccination is to force people to get vaccinated (like they did with smallpox, which doesn't exist anymore, btw). Why are Americans who have access to the vaccinations so fucking stupid they are willing to die for no reason at all?

WA is an employment at-will state, so any employer can terminate any employee without cause or notice for any reason whatsoever, so long as they're not violating any employee protection laws, such as in retaliation against an employee for exorcising a protected right or for filing a complaint under certain employment laws. Such termination is deemed "without cause", which makes the employee eligible to collect unemployment benefits.

So the state refuses to mandate vaccines from any government employees with the political power or connections to simply decide they don't want to get vaccinated.

Thank goodness those in these positions of authority within government are magically incapable of infecting other people because reasons.

For a group that claimed with some justification that schools must remain shut down for over a year due to the safety risk of Covid-19, the now seem amazingly uninterested in requiring everyone in their group be vaccinated for the same safety reasons that kept them closed so long.

COMTE, I'm well aware that Washington is an at-will employment state. I still don't see how they would call sacking someone for refusing a jab anything other than disciplinary.

Also, I wish more people would exorcise their Second Amendment rights.

In the case of a refusal to get a vaccine, it wouldn't be considered "disciplinary", because it's not about job performance, it would be considered a "condition of employment" and there's no blanket protected right, except in the case of an employer with a union contract (in which case it would have to be negotiated), for "sincerely held religious beliefs" or for a bona-fide medical condition, or in which the employee would have had to disclose prior to the termination. Under such circumstances the employer has to try and find some sort of "reasonable accommodation" for the exempted employee, which can include things like reassignment to other duties or remote work. But in many situations, particularly with smaller employers, that may not be practical, and if the employer can demonstrate that no reasonable accommodation can be applied, they can still terminate the employee.

@8, my guess is that the state punted on requiring teachers to get vaxxed because of the teacher's union. It's a contract issue. If the state mandated it without getting sign-off by the unions, they'd likely get flooded with lawsuits.

Having said that, it is the height of stupidity for any teacher to refuse the jab. I can't imagine spending every day in a classroom with 150+ students in and out every day in the middle of an escalating pandemic without a vaccine. That's just suicidal. If the teachers unions have any sense, they should eagerly support any efforts to increase vaccinations among teachers, staff, and students. Teachers have all the time in the world to get their jab while they're out over the summer.

It wouldn't surprise me if the state took a more subtle approach with teachers. Strongly encouraging it without actually forcing it. Encouraging local districts to negotiate it into the contracts before the start of the school year. Many, though not all, districts are in contract negotiations right now, trying to hammer out contracts in the next few weeks.
