Schmacky - agree that it is not child pornography. (Federal definition: any visual depiction of sexually explicit conduct involving a minor.) The legal argument they are making is that because he is nude and "grasping for money" this makes it a depiction of sexual conduct, i.e. prostitution. Which is pretty weak.
However, according to other news articles, the kids' Dad was paid $200 for the photography session by the photographer and never signed a release or received any compensation at all for use of the photo on the album. So I think he probably did deserve some compensation for commercial use of his image. Given the length of time, statute of limitations, etc, claiming child pornography was probably the only legal option available to him.

Child porn is the wrong approach to take for the Nevermind kid. He should sue for having to be associated with the most overrated band in modern history. Who would give a shit about Nirvana if Cobain were still alive? He wasnt even the best Seattle-area grunge singer to die on April 5.

This guy has bragged and bragged about being on the cover of that album. He has taken photos "recreating" the album cover at least twice (with his swim shorts on). He has NEVERMIND tattooed on his chest. He has been on countless shows and in countless news stories about being the baby on the cover.

Someone must have made fun of his penis (current penis, adult penis) and now he thinks he's going to get paid claiming his penis on the cover of Nevermind is child porn and exploitation.

I don't understand; "reinstated Trump's policy " the former guy is not President anymore, Biden is. Now if they are talking about a law passed by Congress, then sure Biden can't override it on a whim, but if it is just the former guy's policy, why not? You can't say the former guy never "appeared to act arbitrarily and capriciously " (probably don't even need to qualify that with "appeared")

The (Nirvana cover) kid's parent(s) signed a model release. That is completely normal and standard practice for commercial photos depicting minors. Case closed. The lawsuit will go nowhere. He can whine and complain all he wants, but the only people he could conceivably successfully sue would be his parents, and even that is a huge stretch.

@38 -- There is a legal procedure that presidents have to follow to implement an executive policy. The same goes for changing a previous policy. @32 -- Yeah, but he was only "that baby" because he told people about it. Holy shit, it is a picture of a baby. I'm sure he looks very different now. He could walk into a record store, hold up the album next to his face and say to the clerk "Excuse me ... I'm not that familiar with grunge. I recognize the cover, but is this a good album?" and no one would have any idea that he is "that baby". He could have done that the rest of his life, or played it even cooler, and only mention it to close friends.

He did the opposite. He obviously went overboard, and owned it. Fine. But to blame someone else for the fame he created is bullshit. The only reason anyone knows he is "that baby" is because of actions he took.
