A driver suspected of killing two pedestrians and critically injuring a new mother and her 10-day-old son in North Seattle on Monday afternoon is being held on $2.5 million bail this afternoon, after the court found probable cause for two counts of vehicular homicide and two counts of vehicular assault, according to the King County Prosecuting Attorney's office.

Court documents say that 50-year-old Mark Mullan was driving on NE 75th Street when he allegedly struck the pedestrians in a crosswalk. "Mullan claimed he was unable to see them due to the sun being in his eyes," reads the statement of probable cause prepared by a responding police officer. It was about 4:10 p.m. and he was driving westbound.

However, on-scene officers also noted that "Mullan had the odor of an alcoholic beverage on his breath," according to court records. When questioned by police, "Mullan admitted to having one 1 1/2 ounce drink of Barcardi and 7-Up this morning." Responding officers went on to give Mullan a series of field sobriety tests, noting that he showed "impairment on all the tests" and that a breath test showed a .22 breath alcohol level (BAC). The legal driving limit is .08. Mullan was arrested and transported to a nearby hospital, where his blood was drawn for a more conclusive alcohol test. Those results are pending, the report says.

A check of Mullan's drivers license, which had a diamond-shape hole punched in it, showed that the suspect's license is currently suspended for DUI and that "he is on probation in Seattle Municipal Court for DUI with conditions that require him to abstain from alcohol, not drive without a valid license and insurance, and to have an ignition interlock in any vehicle he does drive," the court record says. Detectives at the scene reported that Mullan's vehicle had no ignition interlock.

Mullan's next court appearance is scheduled for Thursday, March 28, which is also the deadline for a charging decision, the prosecutor's office states.
