Although there appear to be questions about the competency of the man accused of raping and attacking two women in their South Park home on July 19th , King County prosecutors now say they’ll be filing first degree rape, murder and burglary charges against Isaiah Kalebu.

Facing separate charges in 2008, a state psychologist initially found Kalebu unfit to stand trial, according to court documents. After months of medication, the psychologist reversed his opinion, finding that Kalebu could stand trial but warning that “should he stop taking his medication and decompensate … further assessment of his competency to stand trial would be warranted.”
At a press conference this morning, King County Prosecutor Dan Satterberg addressed Kalebu’s mental state during the crime. “He seemed to be a very confident rapist in charge,” Satterberg said. “He knew what he was doing. In fact, he told the victims that he knew that they would call the police when he left.”
Satterberg also says the brutal attack “appears to be entirely random” and that “there is no evidence of a bias crime or malicious harassment.”
Prosecutors have not said whether they will seek the death penalty in this case.
Kalebu’s arraignment is scheduled for August 12th.

I just don’t get the death penalty. In what possible universe would this guy not be the ideal candidate? Are prosecutors holding out to use the charge as leverage to get a plea? I would think from a political perspective, any ambitious prosecutor would jump all over sending Kalebu to the death house–but maybe I’ve been watching The Wire too much.
