Actually the coroner ruled the death as a homicide, not murder. All murders are homicide but not all homicide is murder, legally. The most they could hope to file against this doctor would be manslaughter.

@1 – My understanding of California law is that the doctor could be charged with 2nd degree murder if the state claimed he showed willful disregard for medical standards and the safety and well being of his patient. Manslaughter if he only showed negligence.
