This is supposed to amount to sexual assault because it involved the kid’s asshole? So if he was kneed in the groin or elbowed in the nipple it would be sexual assault, too, instead of just an illegal wrestling move?
If the court doesn’t throw this absurd bullshit out, then I figure all of high school wrestling is sexual assault. I know *I* certainly can’t watch it without thinking about fucking. Oh, and high school swimming = kiddie porn.

I spent a couple weeks on the wrestling team in middle school, and it’s nothing but physical and mental assault. I didn’t like it, I got the fuck out of there; no charges needed pressing.

All sports have baseline sexual agression and sometimes accidents happen when sweaty bodies collide. Bullshit cases like this are harmful to the real sexual assaults that happen in sports.

My high school allowed girls on our wrestling team. We had a move called the “twat thrust”. Perfectly legal, of course.
Ive seen far worse in an episode of Ren & Stimpy. Makes you wonder what odd manuvers are common in cheerleader or drill team squad practice.

The 30 second number came from the “victim’s” father. I don’t think his account is particularly reliable. I mean, do you think one kid pinned down another and stuck his finger in him for 30 whole seconds? Really? Through his unitard thing, no less? Nobody objected, the trial bout was not called? If you get pinned for that long in wrestling, don’t they call the match well before you hit the 30 second mark?
Maybe the accused was being unnecessarily rough, maybe he is an asshole who was making threatening comments beforehand, but sexual battery is bullshit. The “victim” picked the wrong sport if he does not want hands on his no-no places.

Never heard of this terrible phenomenon. I’m having a difficult time imagining how this move would give somebody an advantage though. Seems like the guy getting the finger up his butt would gain the strength of 10 men. And if he’s in such a disadvantaged position where he can’t even maneuver to get a finger out of his butt then what additional advantage is the insertion gaining other than humiliation?

Or so the kid/his douchebag dad claims. But think for a minute about how likely this actually is. First, the finger(s) would have to either puncture the seat of the kid’s singlet or take all that fabric along for the ride. Second, in case you’ve never tried it, getting a finger actually *up* the ass of someone who hasn’t invited you in isn’t a quickie-oopsie-how’d-that-get-there kind of undertaking. Given the amount of force it would require in a situation like this, there would be screaming involved.

Seeking reassurance, he told his Dad, who already had suspicions about Junior being a homo, and now they’re both having a fit of gay panic and trying to publicly project the sexual content of this incident away from where it really lives — Junior’s brain — and onto the bigger kid, using litigation. Good luck suing the gay away, fellas.

A high schooler sexually assaults a weaker kid as a way to humiliate him. Kids to vicious things to each other sometimes, and there need to be consequences.

It would also be nice to know that you’re not dealing with any complex human interactions on a regular basis. If you do work with kids, I wish there was a way to send your posts to your superiors, so that they can know that you really ought not to be.

@27, it takes the draggee’s mind off his business for a second, which is devastating in wrestling (and most other sports). And it gives the dragger leverage; it’s hard to move a wrestler’s butt if he doesn’t want you to, because there’s nothing to grab onto. Unless there is. Hence the name — dragged by the butt.

The idea that adolescent boys, and athletes in particular, are expected to tolerate a certain amount of sexual harassment, battery, or assault is shameful.

I wrestled and did competitive Judo. I know what I’m talking about. If penetration did occur for more than a tiny millisecond, then it was sexual assault.

I used to wrestle competitively and there is no way your finger is getting up someones asshole through the singlet without MASSIVE force…much more then you could physically provide if your arm was reaching around from the front of your opponent’s body.
What’s probably going on is that the smaller kid is and has been intimidated by the larger kid in practice for awhile, those sort of stressful interpersonal dynamics are normal. Maybe he’s been dominated by the larger kid on the mat in the past, or he simply doesn’t like him. It comes time to practice, the larger kid does the butt drag, perhaps more forcefully then required, but nothing like 30 seconds of anal penetration. When you’re practicing like this there is usually a dozen other guys hanging around and watching. Unless they’re calling ‘assault’ too, then this kid has zero legitimacy.
So, it all becomes a problem when the kid goes home, and macho “RA! RA! WRASSLIN!” dad asks junior how practice went and feeling humiliated that the larger kid beat him (again), he tells his dad he lost in practice today, not because hes smaller and weaker, but because the larger kid stuck his finger up his butt and it really hurt! Shocked (SHOCKED!!) Dad in a twisted desire to save his son’s ‘honor’ calls a lawyer and presses charges.
Basically the larger kid should be chastised for unnecessary roughness and the smaller kid should quit wrestling…he probably already hates it, but it’s the only way he’s gaining the approval of his gung-ho father.

Well I don’t know what did or didn’t happen, obviously. But I sense more than a little gay panic on the part of the father.
@40. It’s just my opinion, of course, but having seen startlingly similar situations among humiliated teammates and their overzealous fathers on several occasions I think its an educated one. The difference being that those situations I witnessed were handled between the two kids, the coach, and their parents rather then litigation. But then again, this was 25 years ago before it was in-fashion to take children and schools to court for ridiculous reasons.
Perhaps this a legitimate assault case, but knowing how amped-up wrasslin’ dads can be, and seeing similar trumped up accusations first hand, which had zero merit other then hurt feelings, I have deep personal doubts about sexual assault.
Wrestling is an intensely physical and intensely intimate sport. Shit happens. I broke a kid’s nose once on accident in the heat of the match. It doesn’t mean I was trying to hurt him, it just happened. Unless this is the final pearl in a string of inappropriate ‘moves’ by the accused, I just don’t see there being merit.
Somehow I can’t imagine a kid going ahead with this lawsuit — which will no doubt make him exceptionally popular in school — if nothing at all happened.
I wrestled for 10 years and never once heard of the butt drag. However if that had happened to me in high school it wouldn’t be that big of a deal because by that time several things had been up my butt already and I’m not even gay.
Nothing needs to have happened; all it takes is for someone to think something happened.

@42, you weren’t there. You don’t know anything about this case. The kid says the fingers went up his butt. If that did indeed happen, that’s sexual assault, not because I say so but because that’s what the law says. Your “I just don’t see merit” doesn’t mean jack in a court of law.

What information do you think the court will have that we don’t to determine if penetration did *indeed* happen? Pictures? Will the court not have to make judgments about the physical possibility of the claimed assault and the credibility of the witnesses, just as we’re doing?

If you don’t want people offering underinformed opinions about matters of dispute they didn’t witness first hand and whose resolution those opinions can’t possibly influence, I think you’re basically calling for the end of blog comments. I’d actually like an answer to the question of why involvement of a butthole, whether penetrated or otherwise, automatically makes this a sexual assault. I mean, I can imagine possible arguments, but I’d like to see it spelled out. If two guys are fighting and one grabs the other’s balls in order to hurt/control him, is it sexual assault, or just assault? Again, I don’t think this is acceptable behavior, but it’s not clear to me that it’s a *sexual* offense.
@49, see, you’re not the first person to ask these questions, which is why we have these things called “laws”. I don’t know what the law specifically says in California, but I do know what it says here in Washington, and I’ll bet California is pretty similar.
