Civil trial for BLM protester killed on freeway began Monday: The question in the civil case brought by the family of Summer Taylor, a 24-year-old Black Lives Matter protester killed on I-5 in 2020, is not whether a tragedy took place, but who is responsible. The Taylor family blames the state’s transportation department and Washington State Patrol for not closing a freeway exit off Stewart Street. The open exit allowed driver Dawit Kelete to enter up the off ramp and accidentally plow into protesters, striking and killing Taylor. Hand recount begins in Washington’s land commissioner race: Before this is over, state election officials will count about two million votes by hand, and conclusively determine if Democrat Dave Upthegrove or Republican Sue Kuehl Pederson will advance to the general election this November and face former Republican congresswoman Jamie Herrera-Beutler. At the last ballot drop, Upthegrove led Pedersen by only 52 votes. As of 2 p.m. yesterday, King County had recounted 52,000 of its 560,000 ballots without finding an error.

Democrats sue Georgia election board: The lawsuit challenges two rules the state’s board recently adopted. They require election officials to conduct a “reasonable inquiry” into election results before certification and allow individual members of county boards to look at “election related documentation created during the conduct of elections.” The plaintiffs claim the policies enable local election officials to chase any perceived election irregularity, introducing chaos and “substantial uncertainty in the post-election process.” Republican Presidential nominee Donald Trump, who as you can remember promoted lies about a stolen Presidential election, praised the three board members who ultimately backed the rules as “pit bulls fighting for honesty, transparency and victory.” (Victory for whom?)

He donated $125 million to MAKE AMERICA GREAT AGAIN INC. to support Trump, and wasted $25 million more on AMERICAN VALUES 2024, a super PAC supporting RFK Jr’s foiled campaign.
Court rules Florida can ban and restrict trans care: Two Trump-appointed Judges on the Court of Appeals for the Eleventh Circuit lifted an injunction against Florida’s gender-affirming care law, allowing the state to ban care for minors and restrict it for adults while Florida appeals its loss in District Court. The judges, Britt Grant and Robert Luck, ruled that the Florida legislature acted in good faith when it passed SB 254 and was not based on “invidious discrimination against” transgender people. The lone dissenter, Judge Charles R. Wilson drew the opposite conclusion, writing that the lower court had sufficient evidence that the law was motivated by anti-trans discrimination. Grant and Luck’s seven page brief essentially reversed US District Court Judge John Hinkle’s 105-page ruling that found the law unconstitutional.

A tragic day for Mariah Carey: The singer’s mom Patricia and sister Alison both died this weekend, on the same day. Carey has said that her mother, an opera singer trained at Juilliard, had been both an inspiration to her and source of pain. Alison, mostly estranged from Carey, had died at 63 from liver failure. In a statement to People, Carey said that she was heartbroken.

It’s not hard to imagine at all, but we don’t have to imagine anything because lawyers can review the state patrol’s standard practices and leverage this information accordingly. Despite what the average citizen might think about the inherent hazards of protesting on freeways, the state still has an interest in preserving public safety when this happens.
It’s not unrealistic for the state to do everything in its power to mitigate risks for protesters, particularly in a free society that values speech where civil disobedience is a routine feature of protest, but there is no way of knowing any of this based on the information we have so far.
We have a robust civil court system where all the relevant information in these cases can be formally reviewed and the case can either be tossed out, settled, or adjudicated for or against the plaintiff based on the findings of this review. If the plaintiff wins or they settle I would assume the state’s liability insurance will be on the hook but I don’t know for sure how these things work. It would likely be whoever pays out when the police kill or violate citizens’ civil rights.
It’s very easy to accuse people of chasing ambulances but the civil courts exist for a reason and oftentimes cases people dismiss as frivolous with little more than the information they glean from a headline find serious negligence or even willful harm. The McDonalds hot coffee case comes to mind. There can be a lot more going on behind the scenes the public would never know about without these cases going forward.

@11 be careful what you wish for, if the state is found liable in this case that will mean they can no longer stand idly by when future protestors take to the highway. They will be incentivized to remove protestors immediately because they now know they will be held financially responsible for any injury or damages incurred by both protestors and those stuck in the protest.
I don’t know that it matters how the case plays out. Either they are liable for taking every reasonable precaution to protect protesters’ safety or they’re not, and they already have enforceable laws to keep pedestrians off the freeways. You don’t have to look too hard to find examples of the police arresting protesters disrupting traffic.
As I see it the case hinges on how much effort they put into keeping protesters safe based on any reasonable expectation and/or their past performance, but I’m not a lawyer which is why I am in favor of reserving judgment and letting the case play out.
A debate confirmed for September 10th. Kamala is not a great extemporaneous speaker, to say the least, and is going against someone who, for all his faults, has ended multiple political careers in debates. This should be watched with bated breath.

Kamala’s camp wanted seated, both hot mikes (obviously so she can dash off the “I’m speaking” line”) seated with notes, etc. Trump wanted the same rules as last debate, mics muted, etc. They have since confirmed that arrangement.

She got off the “I’m speaking” line at Pence a couple times but when he countered something like “Well you should speak the truth” she had no comeback and just kind of stared blankly. Similarly, in her questioning of Kavanaugh, she couldn’t pull off her leading him into a question about if he had talked to other people about a certain case and was easily frustrated by him. Couple this with countless other flubs–she is not a good debater.

@11, @13: The protestor died because of two illegal acts: her own trespassing on the freeway, and another person’s wrong-way driving. I’m no lawyer either, but I imagine it will be hard to argue the state is liable for the damages caused by illegal acts of private citizens. The argument the WSP should have closed an off-ramp against the threat of an already-illegal act would, as @6 noted, seem weak as well; the state can argue that it would be less safe than leaving the ramp open for freeway access by ambulances and other emergency vehicles.
Frankly, I’m happy if this case has a “chilling effect” upon freeway blockages, and other such vanity projects, which wildly inconvenience other citizens for no discernible benefit. Your right to swing your fist ends at the tip of my nose.
Finally, if the BLM protestors wanted to protest in public somewhere, they could have gone to Cal Anderson Park, and protested the violent deaths of young Black men in the CHAZ/CHOP.
